NAMES ON EARTH Terms of Service

1. Operator and agreement

NamesOnEarth.com is operated by Jelantec, Lima / PERU. Contact contact@support.namesonearth.com. These Terms, the Privacy Notice and Refund Policy describe the service. Mandatory consumer and privacy rights prevail over conflicting wording. Please review the checkout details before paying.

2. Eligibility and submissions

You must be at least 18 and have reached the age of majority where you live. Submit your own name or another adult's name only with their informed authorization for public display and sharing. Do not submit a child's personal information, impersonate another person, or suggest verification, endorsement or official recognition that does not exist. Country is optional. You are responsible for checking spelling, country selection, permission and the total price.

3. What you purchase

The purchase is one moderated public name entry, an optional country, a unique entry number assigned after verified payment and access to supported sharing assets while the entry remains public and the service is available. It is a commemorative digital service, not land, property, an investment, a donation, a prize, an official register or an identity-verification product. You do not own the website or a geographic location on its map.

Names may repeat. Counters measure entries, not independently verified unique people. Placement, visual size, highlighting, animation, country artwork and surrounding names can change. We do not promise permanent highlighting, a particular map coordinate, visitors, fame, social reach or completion of a million entries. Generated assets and illustrations may include decorative or AI-created artwork and do not prove a real gathering or endorsement.

4. Pricing, payment and delivery

The current price is USD 1 per whitespace-separated name token, as shown in checkout, with no subscription or automatic renewal. Names are normalized and whitespace is collapsed; apostrophes and hyphens do not separately create billable tokens. The checkout total and any disclosed taxes apply. Your payment provider may apply its own currency conversion or fees.

PayPal processes payment. A browser success message alone does not prove completed capture. Publication follows server verification and remains subject to moderation. Processing, email delivery and rendering can be delayed. Contact support if payment completes but the entry is not delivered; the Refund Policy applies. Future price changes apply to future purchases unless otherwise lawfully agreed.

5. Display period and availability

We commit to make each eligible paid entry available for at least 10 years from its first publication, subject to removal requested by its owner, lawful moderation, or payment reversal. Temporary maintenance and outages may occur. If we cannot meet this commitment, you retain the remedies provided by our Refund Policy and applicable law.

A one-time payment does not promise perpetual hosting. Subject to that commitment and mandatory rights, entries remain available while we operate the service and they remain eligible. We may maintain, change or discontinue features for legitimate operational, safety or legal reasons. We will provide reasonable advance notice of a planned permanent closure where practicable and the remedies required by our commitments and applicable law. We will not use a change to these Terms to remove an already purchased minimum commitment retrospectively.

6. Acceptable use and moderation

Do not submit unlawful material, threats, targeted harassment, hateful slurs, explicit obscene terms, malicious impersonation, personal information without authorization, advertising links, scripts or attempts to evade moderation. Do not attack the service, bypass access controls or limits, harvest names for harassment or marketing, or misuse private links.

AI checks assist moderation and can make mistakes in any language. We may reject a submission, pause publication or hide an entry for a reasonable suspected violation, rights complaint, payment reversal, security concern or legal obligation. Where lawful and appropriate we will explain the reason and offer a support review. Legitimate unfamiliar, ethnic, religious or non-Latin names are not prohibited simply because they are unfamiliar. Any refund entitlement follows the Refund Policy and mandatory law; moderation does not automatically cancel statutory rights.

7. Permission to display and sharing

You grant us a nonexclusive, worldwide, royalty-free permission to process, reproduce, format and display your submitted name and optional country as needed to run the public wall, map, entry pages and associated sharing assets. This permission does not transfer ownership of your name and does not authorize unrelated endorsements or advertising campaigns. Public users can view and use the site's provided sharing features. Removal ends future public display through our service, subject to necessary private records and backup limitations described in the Privacy Notice.

We or our licensors retain rights in the site's software, designs and artwork. You may download and share the personal assets provided to you for lawful personal sharing and social posting. Do not sell the underlying artwork, remove ownership notices to misrepresent authorship, imply our endorsement or use another person's name without appropriate rights. Third-party rights remain applicable.

8. Corrections, removal and private access

Use the emailed private management flow or support address to request corrections or removal. Corrections are reviewed and may require renewed moderation; a material replacement with another person's name is not an automatic entitlement. Verified self-service removal hides an entry. Removing a display entry does not necessarily delete legally retained private records or produce a refund outside the Refund Policy. Entry numbers are not reassigned. Protect management links; support will not require public disclosure of them. Previously saved or externally shared copies cannot be recalled by us.

Cards and videos are generated on demand. Server copies normally expire after one hour and can be regenerated while the entry is eligible. Temporary failures, queues and rate limits may apply; server storage is not a personal archive. These limits do not remove remedies for a materially undelivered or defective purchased service.

9. Responsibility and liability

We exercise reasonable care and skill but cannot guarantee uninterrupted access, perfect moderation, absolute security or removal of third-party copies. To the extent permitted by applicable law, we exclude liability for indirect or consequential losses that were not reasonably foreseeable when the contract was made. For claims arising from a particular purchase, our total contractual liability is limited to the amount paid for that purchase only where that limitation is lawful and fair in the circumstances.

Nothing excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, breaches of mandatory privacy or consumer rights, or any other liability that cannot lawfully be limited. These Terms do not impose an automatic duty on consumers to reimburse every third-party claim. Each party remains responsible for its own unlawful conduct under applicable law.

10. Complaints, governing law and changes

Contact support with your entry/order reference and a description of the problem. We will consider complaints in good faith. You retain any right to contact PayPal, your payment issuer, a regulator or a competent court; contacting us first is encouraged but is not a waiver or mandatory precondition where law provides otherwise.

These Terms are governed by the laws of Peru, subject to mandatory consumer protections and the jurisdiction rights that apply to you. Nothing in these Terms limits your right to contact INDECOPI or another competent authority. Any choice of law or forum remains subject to mandatory consumer protections and jurisdiction rights, including rights available where you habitually reside when applicable. No mandatory arbitration or class-action waiver is imposed by this draft.

We may revise these Terms prospectively and provide any legally required notice. Changes do not reduce accrued rights or retroactively change the essential bargain for an existing purchase without lawful agreement. If a clause is unenforceable, the remaining provisions continue only to the extent lawful and workable.
